These Terms of Service govern your access to and use of www.cosmekor.in 

and your purchase of Cosmekor products. By visiting the website, creating an account or placing an order, you agree to these Terms and the policies linked on the website. If you do not agree, please do not use the service.

3.1 About the store and eligibility

The store is operated by COSMEKOR PVT LTD, H-312, Sharad Industrial Estate, Bhandup (W), Mumbai-400078. You must be legally capable of entering into a contract in India. If you are a minor, the service may be used only through or with the consent and supervision of a parent or lawful guardian as permitted by law.

You may not use the website or products for an unlawful or unauthorized purpose, introduce malicious code, interfere with security, scrape the service without permission, impersonate another person, infringe intellectual property, submit false information, or use the service in a way that harms Cosmekor or others.

3.2 Product information and cosmetic use

We try to present product descriptions, ingredients, shades, photographs, pricing, and availability accurately. Screen settings, lighting, photography, skin tone, and natural product characteristics may affect how a color appears. Lip balm tint is intended to be sheer and may look different across natural lip tones.

Read the product label and ingredient information before use. Cosmetics are for external use unless expressly stated otherwise. Patch test where appropriate, stop use if irritation occurs, and seek qualified medical advice for persistent reactions or known sensitivities. Website content is general product information and is not medical advice. Individual results may vary.

Products and packaging may be updated from time to time where permitted. We may limit quantities, discontinue items, or restrict sales to locations or customers where reasonably necessary.

3.3 Orders, prices and payment

An order is an offer to purchase. Acceptance occurs when we confirm or dispatch the order, subject to stock, payment verification, and serviceability. We may reject or cancel an order for reasonable grounds, including suspected fraud, unauthorized resale, pricing or listing errors, stock issues, or delivery constraints.

Prices are shown in Indian Rupees and will state whether applicable taxes are included. Delivery, COD, or other disclosed charges are shown at checkout before payment. Promotions, gifts, coupons, and discount codes are subject to their stated conditions, availability, and validity periods and generally cannot be combined unless expressly allowed.

You agree to provide accurate, complete, and current billing, contact, and delivery information. Payment is processed through third-party providers. Cosmekor does not control bank or gateway downtime and is not responsible for delays caused solely by those systems, while remaining responsible for obligations imposed by law.

3.4 Shipping, returns and cancellations

Shipping, delivery estimates, order changes, cancellations, returns, replacements, and refunds are governed by the Shipping Policy and Return, Refund & Cancellation Policy published on the website. Those policies form part of these Terms.

3.5 Accounts and communications

You are responsible for keeping your account credentials confidential and for activity under your account. Tell us promptly if you suspect unauthorized access. By providing contact details, you agree to receive service communications necessary for orders, support, security, and policy notices. Marketing communications are subject to your preferences and applicable law.

3.6 Intellectual property

The Cosmekor name, logo, custom C mark, product names, packaging, photographs, graphics, text, video, website design, and other brand materials are owned by or licensed to Cosmekor and are protected by applicable intellectual-property laws. You may use the website for personal, non-commercial shopping only. No content may be copied, modified, distributed, sold, exploited, or used to create derivative commercial material without prior written permission.

3.7 Reviews, feedback and user content

If you submit a review, image, comment, or other content, you confirm that it is accurate, lawful, non-infringing, and does not contain confidential information, malicious code, hate, harassment, or misleading claims. You grant Cosmekor a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, and display that content for operating, improving, and promoting the brand, subject to applicable privacy and advertising law. We may moderate or remove content that violates these Terms.

3.8 Third-party services and links

The website may use or link to third-party services such as Shopify, payment gateways, social platforms, and couriers. Their services may be governed by separate terms. Cosmekor is not responsible for independent third-party content or practices, but this clause does not remove responsibilities that applicable law places on us for the transaction.

3.9 Availability, disclaimers and liability

We may maintain, update, suspend, or modify parts of the website. We do not promise uninterrupted or error-free availability. To the maximum extent permitted by law, the website and general content are provided on an “as available” basis, without warranties beyond those expressly provided or required by law.

To the maximum extent permitted by law, Cosmekor will not be liable for indirect, incidental, special, or consequential loss arising from use of the website. Nothing in these Terms excludes liability or consumer remedies that cannot lawfully be excluded. Where liability can be limited, our aggregate liability relating to a product order will not exceed the amount paid for the affected order, except where a different remedy is required by law.

3.10 Indemnity, severability and waiver

You agree to indemnify Cosmekor against third-party claims arising from your unlawful use of the service, infringement of another person’s rights, or material breach of these Terms, to the extent permitted by law. If any provision is held unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver of that right.

3.11 Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable consumer-protection rights and the jurisdiction of consumer commissions or other authorities, courts at Mumbai, Maharashtra, will have jurisdiction.
